Terms of Service

Welcome to the Turd Burglars, LLC (“Company,” “we,” “us,” and “our”) website. Please read these Terms of Service (the “Terms”) carefully because they govern your use of our websites including https://turdburgs.com and any other websites that we may later own or operate (“Site” or “Sites”) and our pet waste removal services and other products and services we may later own or operate (collectively called the “Services”).

  1. Agreement to these Terms

    By using our Services, you agree to be bound by these Terms. IF YOU DON’T AGREE TO THESE TERMS, DO NOT USE THE SERVICES. IF YOU ARE USING THE SERVICES AND DON’T AGREE TO THESE TERMS, YOU ARE HEREBY EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. If you are accessing and using the Services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, “you” and “your” will refer to that company or other legal entity.
  2. Changes to the Terms or Services

Supplemental terms and conditions or documents that may be posted on this Site from time to time are hereby expressly incorporated herein by reference. We reserve the right to modify the Terms at any time, in our sole discretion. We will alert you about any changes by updating the “Last Updated” date of these Terms at any time and for any reason, and you waive any right to receive specific notice of each such change. If you continue to use the Services, you are indicating that you agree to the modified Terms. We may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.

  1. Access and Yard Conditions

    3.1 Entrance to Property

    Subject to these Terms, you are giving your permission for us to enter your property for the purpose of completing Services.

3.2 Access 

Subject to these Terms, as the client, you are responsible for maintaining safe, unobstructed access into and out of the yard. Failure to maintain access may result in Services not being performed. Additionally, you acknowledge that we are under no obligation to refund or credit your account if we are unable to perform Services due to negligence in this matter.

3.3. Yard Conditions

Subject to these Terms, you agree to keeping your yard maintained and properly landscaped. It is your responsibility to keep the yard free of clutter, overgrown grass, or other obstructions (aggressive dogs, broken glass, construction materials, and any other potentially harmful objects) that may hinder us from performing Services in an effective manner. Additionally, you acknowledge that we are under no obligation to refund or credit your account if we are unable to perform Services due to negligence in this matter.

  1. Pricing and Payment

    4.1 Pricing

    Subject to these Terms, certain features of the Services require you to purchase a subscription plan or one-time service offered by the Company (these Services which require purchase, collectively called the “Paid Services”). Your rights and obligations will be based on the type of Paid Services you choose. Details about the different types of Paid Services, and the limits and available features associated with those Paid Services, are available at https://turdburgs.com.  

    You may change the type of subscription selected as part of the Paid Services at any time by (i) emailing us at pickup@turdburgs.com and following any instructions, if any, we provide to you in response to your change request or (ii) initiating a change through your Account settings within your client portal.

    Pricing, fees, and promotions are subject to change at any time. You will be notified at least one (1) month prior in writing of any pricing changes.

    4.2 Payment

    Subject to these Terms, you acknowledge that we bill monthly on the 1st of every month. Credit or Debit cards on the file will be processed automatically. Invoices with no payment information uploaded to the file will be due by the 15th of every month. Any invoice not paid by the 15th will result in termination of Services until the balance is paid.

    4.3 Authorization for Recurring Payments

    If your purchase of the Paid Services includes a subscription plan, you will be charged the then-applicable subscription fee (“Subscription Fee”) automatically on the 1st of every month, depending on the term of the subscription plan under your chosen Paid Services, at the then-current rate. Subscription Fees are outlined at https://turdburgs.com. Please note that our Subscription Fees are subject to change, although we will notify you before we effect any change in Subscription Fees.

4.4 Cancelling Paid Services

You may cancel your Paid Services at any time but please note that such cancellation will be effective at the end of the then-current subscription period if your Paid Services include a subscription plan. To cancel, you can either (i) email us at pickup@turdburgs.com and follow any instructions, if any, we provide to you in response to your cancellation request, or (ii) initiate a cancellation through your client portal within the Services. You will be responsible for all Subscription Fees (plus any applicable taxes and other charges) incurred for the current Subscription period. 

4.5 Reinitiating Canceled Paid Services

Subject to these terms, you may reinstate Services after they have been cancelled if you desire. Any extended interruption in service may be subject to an initial cleaning fee to resume Services. Pricing and promotions that were held in prior Services conditions may not be available after cancellation of Services.  

  1. Missed Scoops, Vacations, Weather

5.1 Missed Scoops

We will attempt to service your yard per your subscription terms every week. In the event of a missed cleanup that cannot be moved to a different day during the same week, we will have twice the amount of cleanup to Service the following week; should this occur, you are still responsible for 75% of the invoice that week. Credit will apply to the following months invoice. 

5.2 Vacation(s)

Subject to these terms, you agree to advise us if for any reason your pet(s) will not be using the yard for a certain period (vacation, illness, etc) and you do not wish to be charged for any unnecessary visit(s), please let us know in advance. We are not responsible for any credit or refund due to negligence in this matter. 

5.3 Inclement Weather, Routing Adjustments

Subject to these terms, you acknowledge that the Services date and time is subject to change due to inclement weather. We will not perform Services in the hail, lightening, ice, or sleet. Routing adjustments could affect service and you acknowledge that your day of the week for Service is subject to change. We will notify you in advance should a change in Service occur.

  1. Adding/Removing Animals

Subject to these terms, you acknowledge that it is your responsibility to notify us if other pet(s) are brought into and/or leaving the household. Pricing is reflected by the number of dog(s) and failure to notify us of adding any additional animals will result in extra charges and/or termination of service. 

  1. Holiday(s)

Subject to these terms, you acknowledge that we do not perform Services on Federal holidays. If your service day falls on a holiday, we will try to perform Service on another day of that week. If we’re unable to accommodate due to scheduling and routing, the same terms apply as a missed up (5.1).

8. Publicity

You agree that we may identify your dog(s) and you hereby grant us a non-exclusive, royalty-free license to do so on our Site or in any media now or later developed in connection with any marketing, promotion or advertising of the Company or the Services. If you do not want to allow us the right to use your Marks or identify you or your dog (s) you may opt out such marketing requests by emailing us at pickup@turdbugs.com.

  1. Illness in Animals

Subject to these terms, you agree to let us know if your dog(s) are ill and/or not feeling well. If we notice abnormal stools, we will notify you as soon as possible. Airborne diseases are easily spreadable. We will take every precaution to make sure we are not aiding in the spread of any illness (disinfecting and sanitizing tools in between yards, disinfecting and sanitizing shoes). 

  1. Feedback

We welcome feedback, comments, and suggestions for improvements to the Services (“Feedback”) by emailing us at pickup@turdburgs.com. As we need to be able to freely work with your Feedback to improve the Services, you hereby irrevocably transfer and assign all right, title and interest (including all intellectual property rights, such as copyrights or trade secrets) in and to the Feedback, including any and all “moral rights” that you might have in such Feedback, and you hereby forever waive and agree never to assert any and all “moral rights” you may have in the Feedback.

Please refer to our Privacy Policy for information on how we collect, use, and disclose information from our users.

12. Termination

We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice or liability to you, provided that, if you have paid for Paid Services and the termination is not due to your breach of these Terms, the Company will refund you any prepaid fees for the period of your subscription plan under your Paid Services that extends beyond the effective date of such termination. You may cancel your Account at any time by sending an email to us at pickup@turdbugs.com. Unpaid balances are due within 15 days of termination.
